Sexual Offenses

Allegations of sexual offenses are among the most sensitive and impactful issues in criminal law. They can involve charges such as rape, sexual assault, harassment, stalking, exhibitionism, prostitution-related crimes, or sexual abuse. Cases involving children and adolescents are subject to especially strict standards and may lead to serious criminal, professional, and personal consequences.

Before formal charges are filed, an accusation alone can trigger police searches, seizure of digital devices, pretrial detention, restrictions on professional activities, and significant damage to reputation. Anyone accused of a sexual offense in Germany should promptly seek experienced criminal defense legal counsel and avoid making statements to police or prosecutors without legal advice.

Investigations into sex crimes demand a discreet, analytical, and resolute defense. The presumption of innocence applies fully in these cases, even when they attract public scrutiny or emotional reactions. A thorough defense ensures that evidence is objectively evaluated and that an accusation is not mistaken for proof of guilt.

Since alleged offenses often happen in private settings, there may be no independent witnesses or objective evidence. Consequently, proceedings largely depend on the complainant’s statements and the accused’s responses. When testimonies oppose each other, German courts must carefully assess the credibility of each account. Key factors include the origin and development of the allegation, the level of detail and internal consistency, possible contradictions, subsequent communications, digital evidence, and consistency with established facts.

A direct conflict between statements does not automatically lead to a conviction, but false or uncorroborated allegations also cannot be accepted without scrutiny. Effective defense involves reconstructing the events in detail, systematically reviewing case files, and analyzing testimony with legal and scientific expertise.

At DvM Rechtsanwälte, we represent and defend clients in complex sexual offense cases across Germany. Our approach is informed by expertise in witness psychology, forensic psychiatry, digital evidence, and expert opinion evaluation. We thoroughly examine investigations, identify inconsistencies and weaknesses in the evidence, meticulously prepare clients for each step of the process, and challenge unreliable testimony or expert reports when appropriate. Our goal is to protect clients’ rights and seek the best possible results through strategic, discreet, and resolute representation.

Seek legal advice before making a statement or engaging informally with the investigating authorities.
