Compliance and Internal Investigations

Compliance ensures that companies and organizations operate in accordance with applicable laws, regulations, internal policies, and ethical standards. It covers the conduct of management and employees, both within the organization and in dealings with customers, business partners, authorities, and other third parties. An effective compliance program is a central element of risk management. It helps identify misconduct at an early stage, prevent criminal and regulatory violations, reduce financial losses, and protect the organization’s reputation. From a criminal law perspective, compliance is particularly important because violations can lead to internal liability, regulatory sanctions, and criminal investigations. 

As experienced criminal defense counsel, we help companies and public-sector organizations develop effective compliance policies, review existing systems, and respond appropriately when misconduct is suspected. Early legal advice also ensures that criminal exposure, evidentiary issues, and procedural risks are considered from the outset. Responsibility for compliance generally lies with management. 

Appropriate internal controls, reporting procedures, and clear responsibilities must be implemented and monitored. Independent external counsel can strengthen these structures and help demonstrate that management has fulfilled its supervisory and organizational duties.
